OlogyCrew provides a platform that connects service providers ("Providers") with clients ("Clients") for various categories of services. OlogyCrew acts solely as a technology intermediary and does not provide any of the services listed on the platform.
3. User Accounts
3.1 Registration
- Users must create an account to access certain features of the platform.
- You agree to provide accurate, current, and complete information during registration.
3.2 Account Responsibility
- Users are responsible for maintaining the confidentiality of their account credentials.
- OlogyCrew will not be liable for unauthorized access to your account.
4. Service Listings and Bookings
4.1 Provider Responsibilities
- Providers must ensure their listings are accurate and comply with all applicable laws and licensing requirements.
- Providers are solely responsible for delivering the services listed.
4.2 Client Responsibilities
- Clients must provide accurate information when booking a service.
- Clients agree to adhere to cancellation and refund policies set by Providers or OlogyCrew.
4.3 Booking Process
- Bookings are facilitated through the platform. Payment processing and scheduling are managed via integrated third-party services.
5. Fees and Payments
- Providers may be required to pay subscription or service fees.
- All payments are processed securely through a third-party payment processor.
6. Licensing and Compliance
- Providers must hold any required licenses, certifications, or permits to perform their services.
- OlogyCrew reserves the right to request proof of credentials.
7. Liability and Disclaimers
7.1 OlogyCrew’s Role
- OlogyCrew does not guarantee the quality or legality of services provided by Providers.
- OlogyCrew is not liable for disputes, damages, or injuries arising from services booked through the platform.
7.2 User Responsibilities
- Users agree to resolve disputes directly with each other.
- Users must hold adequate liability insurance if applicable.
8. Cancellation and Refunds
- Cancellation and refund policies are determined by Providers.
- OlogyCrew may impose additional fees for cancellations or no-shows.
9. Intellectual Property
- The OlogyCrew platform and its content are protected by intellectual property laws.
- Users may not copy, modify, or distribute platform materials without prior consent.
10. Data Privacy
- OlogyCrew collects and processes data in accordance with its Privacy Policy.
- Users are responsible for safeguarding their personal data shared on the platform.
10.1 HIPAA Compliance
- For services involving Protected Health Information (PHI), Providers are responsible for ensuring compliance with the Health Insurance Portability and Accountability Act (HIPAA).
- OlogyCrew does not store or process PHI unless explicitly stated and agreed upon in a separate Business Associate Agreement (BAA).
10.2 GDPR Compliance
- OlogyCrew complies with the General Data Protection Regulation (GDPR) for users located in the European Economic Area (EEA).
- Users have the right to access, correct, or delete their data and can contact OlogyCrew for such requests.
11. Termination
- OlogyCrew reserves the right to terminate user accounts for violations of these Terms or any applicable law.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law principles.
12.2 Arbitration Agreement
By using OlogyCrew, you agree to resolve any disputes or claims arising out of or related to these Terms, the platform, or services provided through binding arbitration, except as otherwise specified below.
12.3 Arbitration Rules and Venue
- The arbitration will be conducted under the rules of the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules or Consumer Arbitration Rules, as applicable.
- The arbitration will take place in Atlanta, Georgia, or another mutually agreed-upon location.
- The arbitration will be conducted in English.
12.4 Arbitrator and Procedure
- The arbitrator will have exclusive authority to resolve any dispute related to the interpretation, applicability, enforceability, or formation of these Terms.
- Each party will bear its own costs and expenses, including legal fees, unless the arbitrator determines that such costs should be reallocated.
12.5 Exceptions to Arbitration
- You may bring claims in small claims court if your claims qualify.
- Both parties retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property or proprietary rights.
12.6 Waiver of Class Actions and Jury Trial
- You agree to resolve disputes only on an individual basis and waive any right to participate in a class, consolidated, or representative action.
- You also waive your right to a jury trial for any claim arising out of or relating to these Terms.
12.7 Confidentiality
All arbitration proceedings and related documents will remain strictly confidential, except as required by law.
13. Amendments
- OlogyCrew may update these Terms at any time. Users will be notified of material changes.
